Terms of Service

The MatchedUp.com service (the "Service") is a way for people to interact and meet each other online anonymously. MatchedUp.com is owned and operated by Metro Match Inc. (the “Provider”). If you wish to be user or a member of MatchedUp.com (“the Service”) and interact with others anonymously, then you are bound to this Terms & Conditions (“the Agreement”). In order to become a member of the Service, you must read these Terms & Conditions and accept them with your registration process.

This Agreement is a legal document between you and MatchedUp.com. Please read the Agreement carefully before registering on MatchedUp.com. This Agreement may be modified occasionally and will be effective upon posting it on MatchedUp.com. You will not be able to register on MatchedUp.com without accepting the Terms & Conditions as well as the Privacy Statement. Age Limitations

You must be at least 18 years of age to become a member of MatchedUp.com. Under no circumstances can a minor become a member and/or interact with other members of MatchedUp.com. There are no maximum age limits; we welcome anyone over 18 years of age. By using MatchedUp.com, you represent and warrant that you have the right, authority, and capacity to enter into this Agreement and to abide by all of the terms and conditions of this Agreement.

Membership Termination

Either you or MatchedUp.com may terminate your membership on MatchedUp.com at any time, for any reason, without explanation, effective upon sending a written notice to either party. MatchedUp.com reserves the right to immediately suspend or terminate your access to the MatchedUp.com website without notice upon any breach of this Agreement. If MatchedUp.com terminates your membership because you have breached the agreement, you will not be entitled to any refund of unused subscription fees. Even after membership is terminated, this Agreement will remain in effect. Your MatchedUp.com membership is for your sole, personal use. You may not authorize others to use your membership and you may not assign or otherwise transfer your account to any other person or entity.

MatchedUp.com cannot restructure the price of the monthly membership without contacting you and receiving your consent.

Registration

To become a MatchedUp.com member you must read these Terms & Conditions as well as our Privacy Policy to register with us. When and if you register to become a MatchedUp.com member, you agree to provide accurate, current and complete information about yourself as requested in our Registration section. It is also your responsibility to maintain and update your information to keep it accurate, current and complete. You understand that if your member information in the registration is not true, accurate, current or complete in any respect, we reserve the right to terminate this agreement and your use of MatchedUp.com.

We cannot possibly guarantee that every MatchedUp.com member is the required minimum age of 18. We do not accept responsibility or liability for any content, communication or other use or access of MatchedUp.com by anyone under the age of 18 in violation of these Terms & Conditions.

Private Information provided to MatchedUp.com

MatchedUp.com takes all proper precautions to ensure that our members’ personal information, such as: names, addresses, contact information and credit card information are kept confidential. In no way can an individual or group obtain access to this information. MatchedUp.com exceeds industry standards to ensure your personal information stays completely confidential. Not even Employees of MatchedUp.com have access to your information.

Uses of the MatchedUp.com membership

MatchedUp.com memberships are for Individual personal use only. It is meant for people to interact with each other on a personal level anonymously until either party decides to provide their personal information. At anytime any MatchedUp.com member may block another member if they wish not to be contacted by that person for any reason. It cannot be used to directly or indirectly promote any commercial product(s). If for any reason we detect that a MatchedUp.com member is using their membership to promote a commercial product, their membership will be terminated immediately and they will not be entitled to a refund of fees. Illegal and/or unauthorized use of MatchedUp.com, including contacting members for the means of soliciting them and unauthorized framing of or linking to any other website will be investigated. Appropriate legal action will be taken to the fullest extent of the law. MatchedUp.com may limit the amount of e-mails a member may send in a 24-hour period to ensure no spamming to our members. E-mails sent between members will randomly be moderated to ensure proper use, content and no solicitation.

1. MatchedUp.com members will have to be approved by our Moderation System before their account is activated. We search to ensure that no profanity, improper content, and no personal information is given in profile. We also preview every picture on MatchedUp.com, to ensure that none of the above applies. MatchedUp.com has the ability to deny a member or to terminate a member if they do not comply with our Terms & Conditions. MatchedUp.com members are solely responsible for all the content that they place in their profiles or anywhere throughout the website.

2. Below you will find a list of the types of content that are illegal and/or prohibited on MatchedUp.com. MatchedUp.com reserves the right to investigate and take appropriate legal action in its sole discretion against anyone who violates these provisions. You may not post, distribute, or reproduce in any way any copyrighted material, trademarks, or other proprietary information without obtaining the prior written consent of the owner of such proprietary rights. Without limiting the foregoing, if you believe that your work has been copied and posted on the MatchedUp.com service in a way that constitutes copyright infringement, please provide our Copyright Agent with the following information: an electronic or physical signature of the person authorized to act on behalf of the owner of the copyright interest; a description of the copyrighted work that you claim has been infringed; a description of where the material that you claim is infringing is located on the our Site; your address, telephone number, and e-mail address; a written statement by you that you have a good faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law; a statement by you, made under penalty of perjury, that the above information in your Notice is accurate and that you are the copyright owner or authorized to act on the copyright owner's behalf.

Member Disputes

You are solely responsible for your interactions with other MatchedUp.com Members. MatchedUp.com reserves the right, but has no obligation, to monitor disputes between you and other Members. Privacy Statement:

Disclaimers

MatchedUp.com is not responsible for any incorrect or inaccurate content posted on the Site or in connection with the MatchedUp.com Service, whether caused by Users, Members or by any of the equipment or programming associated with or utilized neither in the Service, nor for the conduct of any User and/or Member of the MatchedUp.com Service whether online or offline. MatchedUp.com assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of, User and/or Member communications. MatchedUp.com is not responsible for any problems/technical malfunction of any telephone network/lines, computer on-line-systems, servers, computer equipment, software, failure of e-mail, players on account of technical problems, traffic congestion on the Internet, any website combination thereof, including injury or damage to Users and/or Members or to any other person's computer related to or resulting from participating or downloading materials in connection with the MatchedUp.com Site and/or in connection with the MatchedUp.com Service. Under no circumstances will MatchedUp.com be responsible for any loss or damage resulting from anyone's use of the Site or the Service and/or any Content posted on the MatchedUp.com Site or transmitted to MatchedUp.com Members. The Site and the Service are provided "AS-IS" and MatchedUp.com expressly disclaims any warranty of fitness for a particular purpose or non-infringement. MatchedUp.com cannot guarantee and does not promise any specific results from use of the Site and/or the MatchedUp.com Service.

Limited Liability

Except in jurisdictions where such provisions are restricted, in no event will MatchedUp.com be liable to you or any third person for any indirect, consequential, exemplary, incidental, special or punitive damages, including also lost profits arising from your use of the Site or the MatchedUp.com Service, even if MatchedUp.com has been advised of the possibility of such damages. Notwithstanding anything to the contrary contained herein, MatchedUp.com, liability to you for any cause whatsoever, and regardless of the form of the action, will at all times be limited to the amount paid, if any, by you to MatchedUp.com for the Service during the term of membership.

Indemnity

You agree to indemnify and hold MatchedUp.com, its subsidiaries, affiliates, officers, agents, and other partners and employees, harmless from any loss, liability, claim, or demand, including reasonable attorney's fees, made by any third party due to or arising out of your use of the Service in violation of this Agreement and/or arising from a breach of these Terms of Use and/or any breach of your representations and warranties set forth above.

Other

This Agreement, accepted upon use of the Site and further affirmed by becoming a Member of the MatchedUp.com service, contains the entire agreement between you and MatchedUp.com regarding the use of the Site and/or the Service. If any provision of this Agreement is held invalid, the remainder of this Agreement shall continue in full force and effect.
